This book examines in detail the status of children in the EU. Drawing on a range of disciplinary perspectives, including the sociology of childhood and human rights discourse, it offers a critical analysis of the legal and policy framework underpinning EU children's rights across a range of areas, including family law, education, immigration and child protection. Traditionally children's rights at this level have been articulated primarily in the context of the free movement of persons provisions, inevitably restricting entitlement to migrant children of EU nationality. In the past decade, however, innovative interpretations of EU law by the Court of Justice, coupled with important constitutional developments, have prompted the development of a much more robust children's rights agenda. This culminated in the incorporation of a more explicit reference to children's rights in the Lisbon Treaty, followed by the Commission's launch, in February 2011, of a dedicated EU 'Agenda' to promote and safeguard the rights of the child. The analysis presented in this book therefore comes at a pivotal point in the history of EU children's rights, providing a detailed and critical overview of a range of substantive areas, and making an important contribution to international children's rights studies.

This book is concerned with children's economic and social rights (sometimes referred to simply as children's social rights). Despite increased academic interest in both children's rights and socio-economic rights over the last two decades, children's social and economic rights remain a comparatively neglected area. Section 1 of the Child Poverty Act 2012 requires the Government to report on whether or not the target to reduce the number of children living in relative income poverty by half by 2012/11 from a 1998/99 base was met. This report finds that the target was not met: although the number of children living in relative income poverty reduced to 2.3 million, that figure is 600,000 short of the number required to meet the target. Despite some progress, not enough parents were able to move into work and progress in work. Work did not pay as well as it should, and the proportion of poor children who came from working households increased. Not all poor families received the financial support they were entitled to because the system was complicated and unclear. The fact that the target was not met, despite significant financial transfers, demonstrates that poverty does not have easy answers. Whilst income matters, child poverty will not be eradicated by income transfers alone. The root causes of poverty must be tackled: worklessness, poor educational attainment, health and high levels of personal debt. The Government is setting up a new Child Poverty and Social Mobility Commission to hold Government and other institutions to account on progress in improving social mobility and reducing child poverty. The Child Poverty Strategy will: intervene early to support children and strengthen families; drive up educational achievement and make work pay.

With the passage of the 1996 welfare reform, not only welfare, but poverty and inequality have disappeared from the political discourse. The decline in the welfare rolls has been hailed as a success. This book challenges that assumption. It argues that while many single mothers left welfare, they have joined the working poor, and fail to make a decent living. The book examines the persistent demonization of poor single-mother families; the impact of the low-wage market on perpetuating poverty and inequality; and the role of the welfare bureaucracy in defining deserving and undeserving poor. It argues that the emphasis on family values - marriage promotion, sex education and abstinence - is misguided and diverts attention from the economic hardships low-income families face. The book proposes an alternative approach to reducing poverty and inequality that centers on a children's allowance as basic income support coupled with jobs and universal child care.

The essays encompass many regional cultures and draw on court records and legal debates, field work on government ministries, and an extensive reading of Islamic law. In his overview of waqf (similar to the Western idea of a foundation, in which an endowment is set aside in perpetuity for specified purposes), Ahmad Dallal explains how charity, a central organizing principle in Islam, is itself organized and how waqf, traditionally a source of revenue for charitable purposes, can also become a source of tension and conflict. Donna Lee Bowen, in her essay on the position of women in Islamic law, points out the crucial differences between the Islamic principles of family equity and the Western notion of individual equality. In a subsequent essay, Bowen addresses the problems surrounding family planning and the dilemmas that have arisen within the Muslim world over differing ideas about birth control. The two final essays look at specific instances of how the modern state has treated Islamic social policy. Gail Richardson examines zakat, an Islamic tax used to assist the poor, and its administration in Pakistan. Carol Underwood, meanwhile, explores public health policy in Iran, both before and after the Islamic revolution that deposed the Shah. Addressing some of the most profound misunderstandings between Islamic and Western societies, Islam and Social Policy will be of vital interest not only to scholars and policymakers but to anyone concerned with Islam's critical place in the modern world.

The Convention on the Rights of the Child (CRC), which was adopted unanimously by the United Nations General Assembly in 1989, marked a turning point in the perception of children in international law and policy. Although it was hoped that the Convention would have a significant and positive impact on the lives of all children, this has not happened in many parts of the world. This edited volume, based on empirical research and Non-Governmental Organisation project data, explores the progress of the Convention on the Rights of the Child, and to a lesser extent, the African Charter on the Rights and Welfare of the Child, in nine African countries in the 25 years since it was adopted by the UN General Assembly. The book considers the implementation of the Convention both in terms of policy and practice, and its impact on the lived experiences of children in societies across the continent, focusing on specific themes such as HIV/AIDS, education and disability, child labour, witchcraft stigmatisation, street children, parent-child relationships and child participation. The book breaks new ground in blending legal and social perspectives of the experiences of children, and identifies concrete ways forward for the better implementation of the CRC treaty in the various political contexts that exist in Africa.

Children's rights and Human development is a new and uncharted domain in human rights and psychology research. This multidisciplinary Child Rights Reader is a first attempt to introduce this domain to students and researchers of children's rights, child development, child maltreatment, family and child studies and related fields. For many lawyers, children's rights are limited to their legal dimension: the norms and institutions of international human rights law, often with an exclusive focus on the Convention on the Rights of the Child and its monitoring treaty body, the Committee on the Rights of the Child. However, there are three other dimensions to children's rights. Children's rights share a moral and a political dimension with all human rights, which most non-international lawyers all too often overlook. And children's rights have a fourth dimension: the time dimension of child and human development. This time dimension is multidisciplinary in itself. Human development begins - at least - nine months before child birth. When we are four years old, our brain is ninety percent adult size. The infrastructure of our personality, health and resilience is formed in our first years of life- determined by the quality and sheer quantity of parent-child interaction, and based on the successful outcome of our first developmental task in life: secure attachment formation. Yet, more than one third of our children are not securely attached. According to research published in The Lancet in 2009, one in ten children in high income countries is maltreated. Violence against children is a worldwide plague. Socio-economic and socio-emotional deprivation are still transmitted from generation to generation in both rich and poor states. Investing in early childhood, positive parenting and child rights education makes sense - from both a human, a human development, a human rights, a child rights and an economic perspective. This Child Rights Reader brings together substantial and fascinating texts from many fields and disciplines which illustrate and elaborate this point. Arranged in ten chapters titled according to pertinent child rights principles and concepts, these texts offer a state-of-the-art view of the enormous progress made in the past decades and years in several fields of human knowledge. In between these texts several news and factual items inform the reader on the huge gap that still exists between what we know and what we do to make this world a better place for children, and thus to promote human development and better protect human rights. Child rights violations are still met with more rhetoric than leadership. But change is on its way. The texts in this book may be used both as background readings and as tasks for group discussion in problem based learning or other educational settings in child rights law and psychology courses. This book also aims at a broader academic and public audience interested in the many aspects and ramifications of Children's rights and Human development.
